Terms of Service

These Terms of Service govern the Dominus Training website and the Dominus Affiliate Programming Membership. By starting a free trial, subscribing, accessing the programming, or using the Service, you agree to these Terms. If you act for a gym, company, or other organisation, you confirm that you have authority to bind that organisation.
1. About Dominus Training
Dominus Training is the registered business name of an Australian sole trader operating from South Australia under ABN 95 215 410 096. In these Terms, “Dominus Training”, “we”, “us”, and “our” mean that sole trader business.
“Subscriber”, “you”, and “your” mean the person or entity that starts a trial, purchases a subscription, or accesses the Service. “Affiliate” means the subscribing gym, fitness facility, or training business and does not imply an association with CrossFit, LLC or any other third-party organisation.
2. The Service
The Dominus Affiliate Programming Membership provides access to three complete six-day programming tracks: Balanced, Strength, and Conditioning. Each track is designed as a complete Monday-to-Saturday program for a different affiliate priority.
The Service may include programming, coach briefs, timestamped class plans, scaling options, warm-ups, cool downs, mobility, optional accessory work, and related resources. Content is delivered digitally through Notion, email, or another platform selected by Dominus Training.
The Service is standardised affiliate programming. It is not personalised programming for a particular gym or individual member. It does not include live coaching, on-site supervision, medical advice, rehabilitation, or individual assessment.
3. Trial, Payment Method, and Automatic Renewal
Every new subscription begins with a 28-day free trial unless a different offer is clearly displayed at checkout. A valid payment method is collected when the trial begins.
If you do not cancel before the trial ends, the subscription automatically converts to a paid monthly subscription at the price and in the currency displayed at checkout. The payment method on file is charged automatically when the trial ends, and the subscription renews monthly until cancelled.
Payments are processed by Stripe or another payment processor identified at checkout. You authorise the payment processor to charge the payment method on file for recurring subscription fees and any taxes or charges clearly disclosed at checkout.
4. Cancellation and Refunds
You may cancel at any time through the Stripe customer portal, if made available to you, or by emailing info@dominustraining.com from the email address connected to the subscription.
If you cancel before the free trial ends, no monthly subscription payment will be taken. If you cancel after a paid billing period has begun, access continues until the end of that billing period and no further recurring payment will be taken.
Paid subscription fees are not refundable for change of mind, partial months, or unused access, except where a refund or another remedy is required by the Australian Consumer Law or another law that cannot be excluded. The Refund and Cancellation Policy forms part of these Terms.
5. Licence and Permitted Use
While your subscription is active, Dominus Training grants you a limited, revocable, non-exclusive, and non-transferable licence to use the programming at one licensed physical location.
You may:
share the programming internally with coaches, employees, and contractors working at the licensed location
display workouts and relevant session information to members of the licensed location
copy programming into your gym management software solely for delivery at the licensed location
make reasonable on-floor changes needed to scale, modify, or coach the program safely
You must not:
resell, sublicense, publish, distribute, or commercially exploit the programming or source materials
share access or programming with another gym, location, business, or unauthorised person
use one subscription across multiple physical locations
remove or obscure copyright or proprietary notices where they are included
represent the programming as your own product for resale or external distribution
6. One Subscription Per Location
Each subscription is licensed to one physical gym or training location. A separate subscription is required for each additional gym, franchise location, sister facility, or separate training location that uses the programming. Contact us if you require access for multiple locations.
7. Subscriber and Affiliate Responsibilities
The Affiliate is solely responsible for how the programming is delivered at its facility. Dominus Training is not present on the gym floor and does not know the health, injuries, abilities, training history, or circumstances of individual members.
The Affiliate is responsible for:
using suitably qualified and appropriately trained coaches
screening members and obtaining any medical clearance reasonably required
scaling, substituting, reducing, or removing movements, loads, volumes, and workouts when appropriate
providing active supervision, safe instruction, and appropriate technique standards
maintaining safe equipment, facilities, and operating procedures
holding appropriate insurance, licences, waivers, and permissions required in its jurisdiction
complying with local laws, regulations, industry standards, and any third-party affiliation obligations
The Affiliate must not send Dominus Training identifiable medical or health information about individual members unless Dominus Training has expressly requested it and suitable privacy arrangements are in place.
8. Account Security and Access
You are responsible for protecting any login, invitation, or access link supplied for the Service. You must notify us promptly if access has been lost, compromised, or shared without permission.
We may suspend access while investigating suspected unauthorised sharing, non-payment, misuse, or a material breach of these Terms.
9. Intellectual Property
The website, programming, written materials, systems, formatting, text, graphics, and other content supplied by Dominus Training are owned by or licensed to Dominus Training and are protected by intellectual property laws. No ownership rights are transferred to you.
Feedback may be used to improve the Service. We will not publish your gym name, logo, testimonial, or identifying case study in marketing without permission.
10. Delivery, Availability, and Service Changes
We aim to deliver programming consistently, but we do not guarantee uninterrupted access or delivery at an exact time. We may update the platform, format, delivery method, track structure, or supporting features when reasonably necessary to maintain or improve the Service.
If a material change significantly reduces the paid Service, we will provide reasonable notice where practical. We may correct programming, pricing, formatting, or website errors when identified.
11. Pricing Changes
We may change subscription pricing by giving at least 30 days’ notice before a new price applies to an existing subscription. You may cancel before the change takes effect.
12. Third-Party Services
The Service may use or link to third-party services, including Framer, Stripe, Notion, email providers, and gym management platforms. Those services are governed by their own terms and privacy policies. We are not responsible for a third party’s independent acts, outages, or content, but this clause does not exclude any responsibility that cannot legally be excluded.
13. Fitness and Programming Disclaimer
Exercise carries inherent risks. The programming is a general written resource for delivery by appropriately qualified affiliates. It is not medical advice, rehabilitation, an individual exercise prescription, or a substitute for live coaching and supervision. The separate Disclaimer forms part of these Terms.
14. No Guaranteed Results
Results vary between affiliates and members. Dominus Training does not guarantee specific performance, fitness, member retention, revenue, membership growth, or business outcomes from using the Service.
15. Liability
Nothing in these Terms excludes, restricts, or modifies any right, consumer guarantee, warranty, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, Dominus Training is not liable for indirect, incidental, special, or consequential loss arising from use of the Service. Where liability can lawfully be limited, Dominus Training’s total aggregate liability in connection with the Service is limited to the subscription fees paid by you in the 12 months before the event giving rise to the claim.
16. Indemnity
To the extent permitted by law, you indemnify Dominus Training against third-party claims, losses, and reasonable costs to the extent they are caused by your breach of these Terms, negligence, unlawful conduct, unauthorised sharing, or unsafe delivery or implementation of the programming. This indemnity does not apply to the extent a loss was caused by Dominus Training.
17. Suspension and Termination
You may terminate these Terms by cancelling your subscription. We may suspend or terminate access for non-payment, unauthorised sharing, unlawful use, or a material breach that is not remedied within a reasonable time after notice, unless immediate action is reasonably required to protect users, the Service, or intellectual property.
When access ends, you must stop using and distributing the programming, except for records that must be retained by law.
18. Events Beyond Reasonable Control
Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, serious illness, internet or platform outages, cyber incidents, government action, war, or comparable events. We will use reasonable efforts to resume the Service.
19. International Subscribers
The Service is provided in English and is available to affiliates in Australia and other countries. International subscribers are responsible for the local laws, licences, taxes, bank fees, currency conversion costs, insurance, and operational standards that apply in their jurisdiction.
20. Governing Law and Disputes
These Terms are governed by the laws of South Australia, Australia. Before commencing formal proceedings, each party agrees to give written notice of the dispute and attempt in good faith to resolve it through direct negotiation for at least 30 days. Nothing prevents either party from seeking urgent injunctive relief or using a right or remedy that cannot be excluded.
21. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, or business practices. We will post the revised Terms and update the date above. We will provide reasonable notice of material changes affecting an active subscription. Continued use after a change takes effect means you accept the updated Terms.
22. General
If part of these Terms is invalid or unenforceable, the remaining terms continue in effect. A failure to enforce a term is not a waiver. These Terms, together with the Privacy Policy, Refund and Cancellation Policy, Disclaimer, Cookie Policy, and terms clearly displayed at checkout, form the agreement between you and Dominus Training.
